The Preliminary Hearing System in the Investigation Procedure in China

As an important part of the criminal procedure, the preliminary hearing has played a positive role in the guaranty of the quality of the investigation and effective supervision of the investigation actions. In China, the responsibility of the preliminary hearing is undertaken by the public security division, and the preliminary hearing system presents a diversified pattern. Starting with the relevant summary of preliminary hearing, this paper aims to clarify the historical development of preliminary hearing system in China, to indicate the separation or integration of hearing and investigation and related arguments, and to illustrate the internal function and value orientation thereof. Furthermore, several proposals regarding the trend of the preliminary hearing system in China were provided in this paper, hoping to offer some help to the construction of the preliminary hearing system in China.

Ethnic minorities of China have abundant resources of intangible cultural heritages, and many of them have intellectual property interests that are difficult to count. With the development of society and economy, people are paying increasingly attention to the value of the intangible cultural heritages of ethnic minorities and the realization of the protection of same will be of great importance in the promotion of the economic growth of the ethnic minority areas in China.
